Terms of Service

These terms govern your use of the MainteQC platform. By creating an account or using the service, you accept them. In case of any language discrepancy, the French version prevails (Bill 96).

The service

MainteQC provides operations, billing and technician-management software for service businesses. The service is offered by subscription per the plans described on our pricing page. Pricing.

Accounts & security

You are responsible for the accuracy of your account information, the confidentiality of your credentials, and all activity under your account. Two-factor authentication is mandatory for owner and billing roles. You must promptly notify MainteQC of any unauthorized access.

Subscription, billing & trial

Subscriptions auto-renew at the end of each period unless cancelled before renewal. Free trials convert to paid at expiry unless cancelled. Fees, taxes (GST/QST and other provincial taxes) and refunds are governed by our refund policy. Refund policy.

Your data & content

You retain ownership of the data and content you upload. You grant MainteQC a limited right to host and process it solely to provide the service. Processing of personal information is governed by our privacy policy and data processing agreement. Privacy · DPA.

Acceptable Use Policy

You agree not to, and not to permit any third party to:

  • use the service for unlawful purposes or in violation of applicable laws (including privacy and anti-spam laws — CASL);
  • upload personal information without the required legal basis or consent;
  • send unsolicited communications, spam or deceptive content through messaging or email features;
  • attempt to access other tenants’ data without authorization, or to circumvent tenant isolation or security controls;
  • probe, scan or test the vulnerability of the service without prior written authorization;
  • introduce malware, overload the infrastructure, or abuse quotas (including API, email, SMS and AI quotas);
  • reverse-engineer, resell or sublicense the service without authorization;
  • post hateful, defamatory, fraudulent or rights-infringing content.

A violation may result in suspension or termination of the account, without prejudice to our other remedies.

Service availability

Our availability commitments are set out in our service level agreement. We may perform scheduled maintenance and improve the service over time. Service Level Agreement (SLA).

Termination

You may terminate at any time from your account settings. On termination, we make your data available for export for a reasonable period, then delete it subject to regulatory retention floors (e.g., 7 years for tax records).

Warranties & liability

The service is provided “as is” to the extent permitted by law. MainteQC is not liable for indirect or consequential damages. Nothing here limits your mandatory consumer rights under Quebec’s Consumer Protection Act.

Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute falls under the courts of the judicial district of Montreal.

Changes

We may amend these terms. Material changes will be signaled in-app or by email. Continued use of the service after changes take effect constitutes acceptance.
